Proving damages is a very difficult and chancy biz. Dominion’s lawyers did a lot for the US and for the Smartmatic Voting Machine Co which will be able to build on Dominion’s discovery for their lawsuit vs Fox. Weakening Fox is a societal good achieved by private civil litigation.

If Dominion was awarded $787M in compensatory damages but only proved $125M in actual damages, the judge would likely reduce the jury’s verdict to the lower amount. Even w/ a punitive damages award to punish Fox, all Dominion may have been able to win in a court was $500M ($125M +$375M (3X’s $125).

The $787M Dominion settlement needs some context. Larry Tribe said this was 6X’s Dominion’s provable damages. If true, Dominion’s victory is spectacular. Proving your biz losses resulting from being badmouthed is an iffy thing. Customers don’t say, “I didn’t buy your product b/c of what Fox said.”

So you will be told not to think Trump guilty as he has the presumption of innocence. This is political white noise. Any pundit on the left who says it isn’t thinking and any on the MAGA side is in bad faith. Most of the evidence was made public long ago in M. Cohen. The law lagged behind the facts.

DoJ (FBI) does not properly ‘investigate’ people w/o first a finding that: 1. there has been a crime, and 2. there is probable cause that a particular person is the criminal actor. Grand jury in NYC will vote to indict on Wednesday. The issue is whether the prosecutor proved probable cause. The grand jury heard months of testimony. I mention this b/c Trump ignored probable cause when he destroyed civil servants careers and lives. He used DoJ to ‘investigate’ his enemies.

You don’t have a political trial. Jack Smith could never bump jurors simply b/c they are repubs. With the victims being members of Trumps donor base overcoming a jurors political leanings would be easier. I kind of like the idea.
