Which rules, though? The ones that state we are in violation if we send a private message with sexually explicit content? Or the one that says that our private conversations are encrypted and therefore fully private?

Bottom line is a good lawyer wasn't brought in to work on this stuff and it show

These do not seem to be mutually exclusive. Messages can be encrypted & private & the TOS can prohibit sending sexually explicit encrypted private pictures. If sending sexually explicit pictures to people is what is important to you, perhaps Spoutible is not the social media site for you.

That's literally beside the point. They are suggesting they are policing DMs while claiming DMs are private. It's a policy that reveals a lawyer was very likely not consulted at all.
