Failure of the driver to see/anticipate. Kids on bicycles are like deer. To expect them to act rationally is irrational so it's the driver's fault.

I cant read the article because the link is broken but in general, by law, bicycles in streets have to abide by the same rules as cars. It doesn't matter the age of the cyclist. So the officer will site accordingly.

No i don't. I shouldn't be responsible for your kids playing in the street. That's the parents job to raise their children properly. My parents did. I follow the rules of the road as should anyone on the road. It has nothing to do with being heartless. The law is the law.

Well, I'll be cold then. Keep your kid out of the street or make sure they are ready to ride in the street if they do so. The parents put their kids in harms way. If they cant... keep them in your neighborhood. Cycling is dangerous even for adults.
