I don't think that caveat should stand! To do something with no standing, and no court case to dispute somewhere in the future should still be wrong & illegal.

I think they have a good argument because of the specific timing required in constitution in regards to the electoral activities. If it turned out Trump won when contesting a state, the Dems could have argued he still doesn’t get the ECs because Rs didn’t certify in time. See HI Dems in 1960.
