Excellent point

Although the courts are shy of getting involved in rewriting/reinterpreting contracts, and the defense would likely be 'if you required it to be published, you should have put that in the contract'.

It's not even about the contract itself. I don't even know if they make contracts when they buy stories. It's predatory and misrepresentation.

There's a contract, or the publisher paying 5-6 $$figures couldn't prevent the person from selling same rights to another publisher

It does seem fraudulent. If publication was agreed & implied, they may have a cause of action

But we can also bet contract specifies no commitment to any pub date
