My idea for Judge Marchan: 1. Fine maximum per violation of the order already noted. 2. Warn that each subsequent violation will result in 24 hours at Rikers, suspended until conclusion of trial, regardless of verdict. 3. When violation occurs, note “that’s one more” and provide running total

So there is no delay in the trial. Defendants need to be present when trial proceeds. Alternatively, he could be given evenings in Rikers, but that might be considered interference with his access to defense counsel.
