Trump’s justices argued that Congress could write laws to cover explicit presidential criminal acts - but as shown, head of the senate at the time of impeachment says otherwise. It is not the SCOTUS’s job to legislate — or drive legislation — from the bench (despite their consistent overstepping).

The conservative SCOTUS appears to be arguing that because existing laws don’t explicitly mention the president, there is immunity. Said another way EVERY existing law would need to be reviewed and rewritten to include the president to hold the president accountable.
