I need to know why prosecutors aren’t pushing for jail time as a consequence for violating the gag order.

They already think he’s the victim and the martyr. Putting him in jail for three days for contempt isn’t going to change that, but it may make the Tangerine Napoleon realize that this isn’t a game or a campaigning opportunity.

A toddler will attempt to garner sympathy from their grandparents when their parents take their toys for bad behavior. Just because the grandparents buy more toys, doesn’t mean the parents should stop punishing the bad behavior.

True, but the goal is to keep the proceeding rolling, and give him zero chance for delays. Besides, there’s nothing stopping Merchan (sp?) from giving him 30 days AFTER the fact, guilty OR innocent of the actual trial charges. Plus Merchan can use all this in sentencing him.

Placing a defendant in jail for contempt does not delay proceedings. He would continue to appear. In fact, he can be ordered to serve his time from Friday evening to Sunday evening specifically to avoid a delay.

He’ll appeal, look for a delay while appealing, etc, etc. Delay is his number 1, 2, 3 and 4 moves, and if he lucks into the right judge, he may get it.

You can’t appeal a contempt of court action because it’s at the trial judge’s discretion. These judges just don’t want to seem biased, so they let him get away with things other people would already be jailed for.
