District Take-over History:

1970, William Wayne Justice, chief judge of the USDC for the Eastern District of Texas, ordered the Texas Education Agency to assume responsibility for desegregating Texas public schools, Civil Order 5281.

However, today district residents have witnessed this power abused by state officials while dismissing the state’s failure to address systemic public school issues. Most districts the state seized control of were for failing district ratings.

Four school districts closed out of the 15 taken over by the state. In 2013 North Forest ISD closed after the state seized election control in 2008 for poor academic performance & financial failure by the district. The district was then absorbed into HoustonISD’s population.

North Forest school district opened in the 1920s as an all-white district After desegregation, the demographics flipped to a majority black student population in the mid 80s. However after a series of state laws were enacted in 2000 made it much easier for districts to lose power

State control doesn’t last forever, although the district received a B passing rating in the previous school year, TEA will remain in control of HISD until no campus receives a D or F state rating for multiple years.

The state also requires that the district’s special-education program comply with legal requirements and that there is an established board procedure and conduct that “meet a focus on students” consistent with high-performing governance teams.” According to the TEA statement
