Before a judge is allowed to pass sentence on people with dementia, I would require his honor to walk around for a day with his shirt on backwards, or his underwear on the outside of his pants. "Yes, sir. They SHOULD know better, but the disease doesn't allow them to. You understand, don't you?"

In 1910, Churchill spoke of "the stored up strength of a nation" in regard to the treatment of crime and criminals. And yet, US criminal law, in some areas, is lacking in such strength because /1

My girlfriend hates people on the registry. But her passion is not the same as compassion. Victim surveys show a different, more constructive, way to respond to the harm of sexual violence.

Strict liability laws are a blight on society. No law should be written so strictly “for the greater good” that it directs our judges to “hate the truth for the sake of what we love in place of the truth.” (Augustine)

If by wishful thinking, you reject the idea that the criminal justice system is broken or unbalanced, then you will have trouble accepting the fact that my 77-year-old father was incarcerated in 2018 for a common symptom of dementia. But I assure you it's true.

It's easy to fear sex offenders, but consider that 1 in 330 people in the US are now listed on a registry. So did lawmakers overreact when they ramped up registry convictions with the 2006 Adam Walsh Act in response to highly-published kidnappings? -- Fear wins, respect for the law loses.

Strict liability exploded in the middle of my family’s living room, and continues to divide my family from afar. It is no esoteric concept only for legal scholars; it is very close to our lived experience.

More from ProPublica:
"Leonard Leo didn’t just cultivate friendships with conservative SCOTUS justices, arrange private jet trips, join them on vacation. He also drew on his network of contacts to place his people in clerkships, judgeships and jobs across the federal government."

In the US, there are 1 million people on a sex offender registry. I feel fairly certain (as a matter of logic and reason) that some of them are not evil, also. Just saying... ;)

Half of society thinks that a criminal act is a crime. The other half thinks that mental competency and mens rea is required for there to be a crime. Without a clear agreement, legislatures are passing strict liability laws based on personal bias.

Psychologists may have found a reason for the success of large gatherings over smaller ones. Researchers asked study participants to view photographs of people both alone and in groups. The outcomes consistently unveiled a recurring pattern: individuals appeared more attractive when part of a group.

The human condition is not always beautiful. My dad is dying, slowly poisoned over 14 years by a drug, Tacrolimus, meant to keep his transplanted kidney from being rejected. His brain is mush, and he fails to act decently, but I can see him trying. That's what makes him human. He's trying.

There are three ways the CJ system does not have a factual grasp of dementia

1. Competency restoration is the only available option to those not competent to stand trial, and yet there exists no medical treatment, no restoration, for dementia.

Applying the trickle down theory to moral issues. It doesn't work any better here than it does in economics. "Truly, I don't care if we stomp on his civil liberties. I truly don't." ~ New Jersey Councilman, Mike Howell, addressing a pending lawsuit over residency laws.

In the aftermath of a sexual offense, the state should step in and protect victims from further abuse: who else better to do so? But state efforts on deterring others from committing the same crime are failing 93 to 95 percent of the time. /1

The reason Sex Offender registries are publicly made available is NOT so that hundreds of people can band together in common purpose against an individual. Any such assembly is inevitably going to question the the rule of law and the authority of the courts, usually with a threat of violence.
