It seems to me that if we can have a warning on a jar of peanuts that says "Warning: Contains Peanuts" we can have a warning on "entertainment television" pretending to be news.

No one is going to agree to that even if you and I believe that to be true. My objection covers both sides - if it isn't going to be held to the standards of news, you shouldn't be able to call it news. "News" should be a protected term for this type of scenario.
