When theory is used it science, it means something different than it does elsewhere, often to our detriment.

In this case "theory" is short for theorem and is a grouping of scientific laws to answer a hypothesis IN CONTEXT.

The fact is that Einstein ASSUMED C to be constant, that is the speed of light in a vacuum.

If C were ever found not to be a constant - then the entire theory of special relativity falls apart at the seams.

So far, all experiments have borne this out, and the theory holds.
