I was a nurse when the HIPAA law was enacted. Can some smart lawyer on here please explain it to me how state law passed by religious zealots to obtain the health information of women and transgender individuals usurps federal laws. It goes against every inservice I have taken.

Not a lawyer.

As I understand it HIPAA protects the data from misuse by health providers.

Anyone else is fair game to do anything they want with it. This includes employers, unless they are health providers. Here is the note I took a couple years ago:

They are obtaining it from healthcare providers. As a healthcare provider I would only be allowed to release the information, even those listed, with the patient’s consent or with a court order.
