I was a nurse when the HIPAA law was enacted. Can some smart lawyer on here please explain it to me how state law passed by religious zealots to obtain the health information of women and transgender individuals usurps federal laws. It goes against every inservice I have taken.

Not a lawyer.

As I understand it HIPAA protects the data from misuse by health providers.

Anyone else is fair game to do anything they want with it. This includes employers, unless they are health providers. Here is the note I took a couple years ago:

They are obtaining it from healthcare providers. As a healthcare provider I would only be allowed to release the information, even those listed, with the patient’s consent or with a court order.

As I understand it, it restricts the medical community (DRs, hospitals, Medicare, etc.) from sharing. If we give it to other parties (as DeSantis would like via an app), they are not restricted.

I always had to have written permission from a patient that specifically listed who they were giving permission for their medical information to be released to. None of the forms had politicians listed.

Aren't these laws asking for reporting outside of a hospital setting? HIPPA only covers hospitals & clinics. If your coach or teacher asks HIPPA doesn't come into.play.

Actually HIPAA laws apply to anyone who has access to Health info/medical records and PII information as part of their employment/service.

They send information redacting anything that is personal, such as name, age, address, thus bypassing HIPAA law.

That isn’t what is being requested in Florida and Texas. They are seeking out pregnant females and people who may be receiving gender affirmative treatment. They definitely want the names.
Btw, I still wouldn’t be able to give out patients records with redactions.

Missouri's doing it to if memory serves and they're on a witch hunt. The hospital's compliance means they're likely redacting all personal information (patient x/y/z). In Ms they were looking for youths and gender treatment "abuses" to justify their so-called legislation

It’s happening across our country. I became a nurse, but we all took history lessons. This feels like Nazi Germany to me. They didn’t just try to increase white population, but annihilated Jews, Africans, homosexuals and transsexuals.
