I will say, at least re our Founders, they did leave a lot of information in their own writings. 🙂

Doesn’t seem to change the dynamic. “Original intent” of founders always seems to align with “present desires” of Justices. #scotus

Well, when the goal is to take the Country back to the 1850s (or further back), using the thoughts/ideals/positions of men who wrote them in the 18th Century would tend to support one's views, yes?

Not necessarily. Example: I don't think the original intent was that jurisprudence would be based upon the founders original intent (whatever that means--I don't know what I "intend" by writing this spout!). That doesn't stop Justices today from insisting that it was indeed their original intent.
