There is no requirement that Dominion settles, no matter how much is offered.

But there is this quirky thing called “offer of judgment,” which is essentially admitting liability which obviates the need for trial.

Dominion's reputation was demolished by Fox. Unless the deal involves a month's worth of non stop apologies on Fox News then Domini are suckers.

Not sure I agree.

When we talk about free speech, Fox has the legal upper hand.

When we talk about business profits…not so much. Dominion has already passed the hardest hurdles.

I think Fox is screwed. They won’t pay up any time soon, but the damage will be done.

Offers of judgment are rarely accepted - plus Fox does not want a judgment of liability - they would rather a settlement with no admission of liability. An offer would put some pressure on Dominion which would have to do better than the offer, or Fox could get some of its costs paid by Dominion.

It seems the consensus is that Dominion should not settle, thus bringing major right wing lie peddlers to the surface. I hope Dominion follows through and takes it all the way to court. It would be hard for the Fox MAGA republican crowd to yell fake news when the truth is too hard to ignore.

DVS is owned by private equity and while we appreciate the ethical argument, this suit is an attempt to restore the lost funds. Depending on what Fox brings to the table the board may be compelled to settle.

Not sure Fox would do an offer of judgment on something that requires malicious intent, but be ready for desperate moves to avoid Murdoch testifying in open court.
