The Constitution does NOT stipulate the number of Supreme Court justices — Congress does. The size has changed 7 times over the years, varying from 6 to 10 seats. There are currently 13 federal appellate courts, and many say it makes sense to expand the Supreme Court to 13 seats.

does that "7 times" include when McConnell virtually and unilaterally, without legislation, reduced SCOTUS to 8 seats for a year?
