Because he hasn't been convicted of anything yet. In particular, he hasn't been convicted of insurrection or rebellion.

It's a complete waste of time trying to keep him off the ballot until and unless a conviction is obtained somewhere. No judge will go out on that limb all alone.

An impeachment is the political equivalent of an indictment. The House brought charges, and the Senate failed to convict.
