Just a casual reminder that in 1869 it was decided to have 9 Supreme Court justices because there were 9 Circuit Courts.

Now there are 13 Circuit Courts. So what exactly are we waiting for?

I'm pretty sure it's more complicated than that, but it's a very alluring idea.
Typically whenever someone suggests that there's an easy answer to a complex problem, it's because they don't understand the issues or they're missing essential information.

It actually isn't more complicated than that. Per the Constitution, Congress has the power to determine the size of the court as well as what types of cases the court has jurisdiction over.

Exactly. The Congress. Can you see the US Congress as it's currently constituted doing that? Even if Dems had the majority in both Houses, how much of a majority is required? Will obstructionist Dems vote according to the party's wishes? Many have stated that they will not. So, it's complicated.

As currently constituted, no, but the election is 17 months away, and we *can* take back the House and increase the majority in the Senate by at least one D. That would be sufficient to remove the filibuster in the Senate and pass the court increase in both houses. No special majority required.

How do you see Dems gaining a seat with this map?

Sinema is vulnerable in AZ, and if we can GOTV in TX, Cruz is, too. Josh Hawley in MO is a candidate for replacement, as is Marsh Blackburn in TN. None of them will be easy, but they are all possible.

You are assuming that all Dems will vote for it.

Hakeem Jeffries is a savvy whip and is being mentored by Nancy Pelosi. As speaker, he could manage it in the House, and one more D in the Senate would negate the influence of Manchin and Sinema. Sinema is going to have a tough row to hoe for re-election this time, and she can be beaten.
